Statutory Homelessness Reviews

Part 7 of the Housing Act 1996 as amended by the Homelessness Act 2002 governs the Council's duties to individuals who make homeless applications. The Council has a duty to decide whether an applicant is eligible for assistance and if any duty is owed to them. An applicant has the right to request a review of such a decision under section 202 of the Housing Act 1996. The Local Authorities (Contracting out of Allocation of Housing and Homelessness Functions) Order 1996 ("the Order") enables the Council to contract out a number of its homelessness functions, including its statutory homelessness review function.
